SAPA stands for Sales Agreement by Private Arrangement. It sets out the terms of sale. The Costa Difference Team, acting as the park’s customer service agent, prepares the contract in Spanish, including an English-translated copy.Â
The contract sets the terms and safeguards for the seller and buyer. The SAPA agreement is included if the seller uses the Costa Difference Team as the third party overseeing the sale process.
NOTE: Purchasers of homes advertised for sale on Facebook or other classified sites do not automatically qualify for the SAPA agreement service unless our terms and conditions for private sales within the park specify that, due to circumstances, the sale must include the service as one of the sale approval requirements.Â
Functions of the SAPA agreement.
- Contract the price and completion date (max three months).
- Set the terms for the 10% deposit. Refundable until SAPA is signed.
- Ensure the inventory is correct prior to completion.
- Ensure basic home check prior to completion.
- Ensure major items (boiler, fridge-freezer) are seen working.
- Ensure aircon units are serviced prior to completion.
- Checks to confirm that the home is debt-free prior to completion.
- Guarantee of vacant possession before final payment.
- Guarantee a park contract to the purchaser.
- Guarantee payment for the home has been received by the seller before the handover of the keys.
- Guarantee a Compra/Venta document is issued by the park legally confirming new ownership.
The park is not involved in buying or selling homes in the park. Purchasers buy the homes directly from the owners. The SAPA agreement is beneficial for ensuring the sales process is conducted in the correct order.Â
Without a third party like the Costa Difference Team involved, there can be no SAPA agreement. They are tasked with securing the offer to buy, governing the 10% deposit, checking for no debts on the home, inspecting the home, and securing vacant possession before purchase.Â
