Would you be comfortable going into a bank and taking out between £20,000 and £70,000 to give to someone for their home after seeing it? The risks are the same, whether it is in cash or by bank transfer.
Here are five known risks if you were to do that.
- Is the sale within the park approved?
- Will everything that you think you are buying be included?
- Will it come with outstanding debts that become your responsibility under Spanish law?
- Will a park contract in your name be guaranteed?
- Is vacant possession included with a compra/venta document issued?
Buying a mobile or park home is similar to buying a car in Spain; lawyers are not usually involved unless a buyer instructs them at their own expense.
Fortunately, in Park La Posada, there is a system that removes the risks: the SAPA agreement (Sales Agreement by Private Arrangement). Our customer support agents, Costa Difference, act as a third party to draw up the sales contract (in Spanish with an English translation) and oversee legal obligations that remove risks one by one.
- Homes offering a SAPA agreement have authorisation in place.
- The home with standard fixtures and fittings is checked along with an inventory before the purchase is completed.
- All debts on the home are checked and confirmed as paid, ensuring a debt-free purchase at the time of completion.
- Eligibility for a park contract is confirmed as part of the process with a park contract guaranteed. A free translator service is offered to register the home in the new name with the local authorities.
- Under the terms of a SAPA agreement, the home must be vacated, and all keys must be in possession of the park or park agents BEFORE the final payment.
Almost every resident currently living in the community purchased their home with the protection of a SAPA agreement, so we know it works well. For that reason, only homes for sale offering the terms of a SAPA agreement service will be advertised on this site.
Offering a home for sale in the park with a SAPA agreement is not compulsory. Owners can advertise their homes for sale privately, and a system allows them to do so. Owners can make an application to sell privately in reception.
Potential buyers should consider the following factors before making an offer to buy privately, certainly before making any payment.
- Has the park pre-authorised the sale?
- If the home is over 15 years old, has it passed the pre-sale check?
- Will a park contract be guaranteed?
- What guarantees that the home is debt-free?
Payment for a home does not guarantee a park contract if the procedures for selling a home privately in the park are not completed. The Park Management accepts no responsibility for issuing a contract based on the sale itself. All terms and conditions for issuing a new contract must be in place in advance.
