Buying a home risk free in La Posada

Buying a mobile or park home in Spain is similar to buying a car, so lawyers are not usually involved. 

At Park La Posada, we use a risk-mitigation system: the SAPA agreement (Sales Agreement by Private Arrangement). Our customer support agents at Costa Difference act as a third party to draft the sales contract (in Spanish with an English translation) and oversee the legal obligations that remove risks one by one.

  1.  Homes offering a SAPA agreement have pre-authorisation in place.
  2. The home, including standard fixtures and fittings, is inspected, and an inventory is prepared before the purchase is completed. 
  3. All debts on the home are verified and confirmed as paid, ensuring a debt-free purchase at completion.
  4. Eligibility for a park contract is confirmed as part of the process, and a contract is guaranteed. A free translator service is offered to register the home in the new name with the local authorities. 
  5. Under the terms of a SAPA agreement, the home must be vacated, and all keys must be in possession of the park or park agents BEFORE the final payment.

Almost every resident currently living in the community purchased their home under a SAPA agreement, so we know it works well. For that reason, only homes for sale that offer the terms of a SAPA agreement will be advertised on this site.  

Buying a home on your own

Offering a home for sale in the park with a SAPA agreement is not compulsory. Owners can advertise their homes for sale privately, and a system allows them to do so. Owners can make an application to sell privately in reception. 

Potential buyers should consider the following factors before making an offer to buy privately, certainly before making any payment.

  1. Has the park pre-authorised the sale?
  2. If the home is over 15 years old, has it passed the pre-sale check?
  3. Will a park contract be guaranteed?
  4. What guarantees that the home is debt-free? 

Payment for a home does not guarantee a park contract if the procedures for selling a home privately in the park are not completed. The Park Management accepts no responsibility for issuing a contract based on the sale itself. All terms and conditions for issuing a new contract must be in place in advance.
